Samsung is making one last effort to avoid Apple patent suit payout

While Samsung did finally agree to pay Apple the $550 million over patent infringements, there was one little stipulation, Samsung wants the chance to win some of that money back in court and has filed an appeal with the US Supreme Court in one last effort to prove how ridiculous some of Apple's patent claims are. As it stands right now, Samsung is paying for things like having 'rounded edges' on some smartphones.

Samsung claims that it shouldn't actually have to pay more than $399 million in this case and says that the original ruling is based on law that is outdated.

There have been problems with the US patent system for a while, which has paved the way for entire companies to operate purely on lawsuits for patents they own but have no plans to make use of. Samsung's appeal to the US Supreme Court claims that juries in its case with Apple didn't have enough information:

“Samsung is escalating this case because it believes that the way the laws were interpreted is not in line with modern times. If the current legal precedent stands, it could diminish innovation, stifle competition, pave the way for design patent troll litigation and negatively impact the economy and consumers.”

This lawsuit has been going on for years, at first courts ruled with Apple, ordering Samsung to pay out over $1 billion but after several appeals, Samsung has been able to cut that number in half and could cut it down further if the US Supreme Court agrees to evaluate the case and have a retrial.

KitGuru Says: Samsung isn't wrong about the law regarding patents being out of date. The court still has to grant the appeal, but it looks like we haven't heard the last of this just yet.
