A class action lawsuit has been taken against Apple in California due to “unsavory, dishonest and deceptive business practices” by offering iOS 4 update to iPhone 3G users, while they apparently knew it could render many of the devices unusable.
On October the 29th lawyers from Cohelan Khoury and Singer, a ‘class action law firm' filed the suit in a San Diego County state court of behalf of lead plantiff Bianca Wofford. The claim against Apple is that they made ‘false statements' representing the iOS 4 upgrade as a ‘significant advance and triumph' while in fact it turned the plantiff's iPhone 3G into a ‘virtually useless iBrick.
The plantiff says that the software update has ‘rendered the iPhone 3G devices virtually unusable, constantly slowed, crashed or frozen.' Apple engineers are accused of waiting for nearly 3 months to fix the problem even though they were ‘acutely awar of the thousands of complaints lodged.'
Wofford is also stating that Apple are not allowing customers to downgrade the iPhone 3G from iOS 4 to iOS 3x in the attempt to manipulate customers into purchasing the iPhone 3GS or iPhone 4. She claims her iPhone reliability has dropped from 99 percent to 20 percent functionality after the ‘upgrade'.
Wired claim that the suit requires judge approval to gain class action status.

This is one aspect of the USA I find very unsavoury. The fact that anyone can sue any one else over the smallest of things.
I am not saying this is ‘small’ but why not discuss this with Apple reps in a store first? I am sure they would have fixed her phone.
Tim, your either new to apple or blind as to the state of the realm.
If any part of Apple was even remotely reasonable or sympathetic, they wouldn’t have done this in the first place. In addition, if it is not an apple endorsed practice to downgrade to iOS 3x, why would you think that a lowly peon of jobs mob would risk his soul and dare to defy his master by working around it?
Well…. between all the iPhone 4 problems and MB/MBA problems maybe Apple will stop selling as well…..
