Apple try for wider Samsung ban, but fail

Apple were successful in getting a sales block on the Samsung Galaxy Tab 10.1 tablet, but their latest efforts in Australia have been rejected by the court. They wanted to force Samsung to give them advance notice of new product releases and be restricted in their launch of all new tablet computers. The judge rejected the application.

Justic Annabelle Bennett said “It doesn't apply to any other player in the marketplace.”, referring to Apple's attempted to vet all upcoming releases from Samsung. She has however stopped Samsung releasing their current 10.1 tablet in Australia.

Sales of the iPhone

Samsung are very unhappy so far with the case progress saying that the ruling is commercially killing their chances of mounting a challenge against the iPad in Australia.

To rub salt into the wound, Apple were launching their iPhone 4S on the same day, in fact the flagship Apple store is just 10 minutes walk from the Federal Court of Australia.

Australia might not be a key territory for either company, but the loss of sales will hit Samsung, especially as Apple are running rampant in the region, claiming all the top sales figures for their mobile devices.

Apple are claiming touchscreen technology infringement and their success in Australia will assuredly push them into more actively trying to block Samsung in other regions.

Kitguru says: The legal battle continues.
