T-Mobile fighting US ban on Samsung products

T-Mobile USA have attempted to prevent a preliminary injunction by Apple against Samsung, to stop sales of the Galaxy 10.1 tablet and Galaxy S 4G smartphone. They claim that the sales damage would be high.

T-Mobile said in the brief to the United States District Court of Northern District of California, San Jose Division that the injunction would hurt their company and thousands of US customers. They have also asked to appear at the preliminary injunction hearing on Oct. 13 to present an oral argument on issues relating to the amicus Curiae brief.

Apple are trying to stop Samsung selling, or importing some of their products, including the Galaxy Tab 10.1 tablet and Galaxy S 4G smartphone. They claim that these products infringe on their patents.

Verizon Wireless have also asked the court to refuse the Apple motion for a preliminary injunction in the U.S. They say that it could cause problems for their high speed LTE network development, and potential cause the loss of jobs and expansion of access.

T-Mobile said that the case between Samsung and Apple can go ahead, but they added that “a preliminary injunction is a drastic and extraordinary remedy that is not to be routinely granted.” They have already purchased a large inventory of devices for the end of year holiday sales and are concerned that if the sale is blocked then they will be left holding the products, unable to recoup the costs.
