Last month it was revealed that Samsung and Apple were pressured into entering settlement talks over the course of two of days at a Californian court. The two mobile giants met there this past Monday and Tuesday where Magistrate Judge Joseph C. Spero oversaw the proceedings.
As you might have already guessed no agreement was made according to reports. Both CEOs were present at the proceedings, as was Samsung's head of the mobile division. Because both parties were sticking with their guns, no agreement was made. Samsung continued to pursue royalties from Apple for alleged use of its wireless transmission technology while Apple still insisted that Samsung copied Apple's products for use in their devices.
As such, they will both be back in court in June, even though they both expressed interest in avoiding trials. On June 7th, the court will hear Apple's request for a preliminary injunction against Samsung's Galaxy Tab 10.1. If no resolutions are discovered here then a trial will commence from the 27th of June.
KitGuru says: Perhaps the court system should just put this case in front of an extended jury. Many pointless patent wars would be over in weeks.
As I have said in the Google vs Oracle trial. Any case with a shaky foundation is doomed to fail. In this case, Apple will have big repercussions upon failing because the licensing of FRAND will be set by the courts as restitution. Apple’s lawyers have crossed the line with this one. We shall see the outcome not too long from now. It will be a strong warning to any market leader to not cross the line as Oracle has done so.
Apple ought to innovate and move on rather than ask others to “invent their own stuff”!. Yeah, they did and it ended up looking similar, then Apple shouts “they copied ours”!.
