Samsung ask Apple to disclose upcoming iPad/iPhone samples

Samsung are seeking a court order to force Apple to disclose iPhone and iPad models under development. They claim that they need information to defend allegations of copying.

They say they need to “evaluate whether a likelihood of confusion exists” between Apple and Samsung products which could go on sale at the same time. Documents were filed on May 27th in a California federal court Samsung are asking Apple to turn over the samples by June 13th.

A month earlier Apple asked the court to order Samsung to disclose unreleased products according to the filing. This is part of an ongoing legal dispute between the two companies. Apple claimed Samsung's Galaxy products ‘slavishly' copied their iPad and iPhone technology and design.

Samsung supply chips to Apple for some of their product designs and they counter sued saying that they need to be in a position to compare devices in development. Samsung said that Apple may try to seek a court order barring Samsung from selling future products according to court papers.

The case is Apple Inc. v. Samsung Electronics Co. 11-cv- 01846. U.S. District Court for the Northern District of California (San Jose).
