Judge denies Apple request to ban Samsung phones

A federal judge has rejected a request from Apple to ban U.S. sales of smartphones from Samsung.

Lucy Koh, a U.S. District Court Judge denied Apple's request saying that they were unable to show that Samsung's actions support an injunction.

She said “Apple's evidence does not establish that any of Apple's three design patents covers a particular feature that actually drives consumer demand.”

In August, a jury found Samsung violated six Apple patents and awarded the company $1.05 billion in damages.

Koh wrote “The Court further found that though there was some evidence of loss of market share, Apple had not established that Samsung's infringement of Apple's design patents caused that loss.”

Apple had wanted to ban 26 Samsung devices from U.S. stores and they also wanted another $500 million damages on top of the $1 billion they were awarded in August. Samsung were fighting to get the amount reduced. Koh has not yet issued an order on the amount of damages.
